WWF-India in collaboration with Enviro Legal Defense Firm has carried out legal analysis of the Civil writ petition number 337 of 1995 filed by WWF-India commonly known as the CEL or National Parks/Sanctuaries case and Civil writ petition number 202 of 1995 commonly known as the Godavarman Case.
These cases are being heard for over thirteen years and are a part of what is termed as "continuing mandamus", whereby the Courts, rather than passing final judgments, keep on passing orders and directions with a view to monitor the functioning of the executive. The impact of these orders on PA management, forestry sector, forest management and governance are often not known by many environment and human rights groups or even government agencies. Existing methods of reporting such judgments and orders are often inadequate and at times do not reach the concerned groups. It was thus felt that a comprehensive analysis of the various orders and interventions of these cases should be carried out and their impacts/ implications on the ground are assessed.
