The application was filed against location of electric sub-station in village Jharsently, District Faridabad, Haryana. According to the applicant-Resident Welfare Association, the site in question is having number of trees. Though it is a public utility land, the villagers have developed a park by planting trees. Thus, setting up electric sub-station will damage the park.
Tribunal did not merit in the application. The site in question was already designated as public utility site. Thus, setting up of an electric sub-station at such site cannot be held illegal warranting interference by Tribunal. Also, no damage to the trees is shown by setting up of electric sub station on land meant for this purpose. The application was dismissed.
